Welcome to Qr Max Maker. These Terms of Service ("Terms") govern your access to and use of our website and services (collectively, the "Service"). Please read them carefully.

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Description of Service

Qr Max Maker provides tools to create, customize, and (for registered users) manage static and dynamic QR codes, as well as forms linked to QR codes.

2. User Accounts

• To access certain features (like dynamic QRs and forms), you must register for an account.
• You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account.
• You must provide accurate and current information during registration.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree not to use the Service to:

• Create QR codes that link to or contain content that is illegal, harmful, threatening, abusive, defamatory, vulgar, obscene, fraudulent, invasive of others' privacy, or objectionable on racial, ethnic, or other grounds.
• Generate spam or misleading QR codes (phishing).
• Transmit viruses, malware, or other malicious code.
• Infringe upon the intellectual property or privacy rights of third parties.
• Attempt to gain unauthorized access to our systems or other users' accounts.

You are solely responsible for the content and consequences of the QR codes and forms you create using our Service.

4. Advanced Features, Subscriptions, and Payments

Qr Max Maker offers a free plan with basic functionalities. Access to advanced features, such as a higher number of Dynamic QRs and Dynamic Forms, scan statistics, and other "Pro" functionalities, may require a paid subscription ("Pro Plan").

• Plans and Pricing: Specific details of Pro Plans, including their features, prices, and billing cycles (e.g., monthly or annual), will be clearly presented on our Pricing page and at the time of subscription.
• Billing and Renewal: Pro Plan subscriptions are recurring. You will be billed automatically at the start of each billing cycle (monthly or annual) using the payment method you provide. Your subscription will automatically renew unless you cancel it before the end ofthe current billing period.
• Payment Processor: We use Stripe, a secure and reliable third-party payment processor, to manage all transactions. Qr Max Maker does not directly store your full credit or debit card details. Payment information is handled according to Stripe's security standards.
• Subscription Cancellation: You may cancel your Pro Plan subscription at any time. Cancellation will typically take effect at the end of the billing period you have already paid for. Upon cancellation, your account may revert to a free or limited plan, and you may lose access to Pro features and data or QRs/Forms exceeding the free plan limits. Detailed instructions on how to cancel will be available in your account dashboard (when implemented) or by contacting our support.
• Refund Policy: Generally, subscription payments are non-refundable once the service period has begun, even if you cancel before the end of the billing cycle. Your access to Pro features will continue until the end of the paid period. Exceptions to this policy may be considered on a case-by-case basis at our sole discretion.
• Price Changes: We reserve the right to modify subscription fees. We will provide you with reasonable prior notice (e.g., via email or a website notice) of any price changes that may affect you, giving you an opportunity to cancel your subscription before the new price takes effect for your next renewal.

5. Intellectual Property

• The Service and its original content (excluding user-generated content, such as the data within your QRs), features, and functionality are and will remain the exclusive property of Qr Max Maker and its licensors.
• You retain ownership of the data you input to create your QR codes and forms. You grant us a limited license to use that data solely for the purpose of providing the Service (e.g., generating the QR, redirecting, delivering form responses).

6. Limitation of Liability

The Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express or implied.

To the maximum extent permitted by applicable law, Qr Max Maker shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including, without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any content obtained from the Service; (iii) unauthorized access, use, or alteration of your transmissions or content.

7. Modifications to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 15 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of Mexico, without regard to its conflict of law provisions.
